Refund Policy

Overview
This Refund Policy applies to all Club Kaya coaching enrollments. By signing the client agreement and beginning the program, the Client agrees to the terms set forth below. This policy is incorporated by reference into our Terms of Service and the signed client agreement.
The Conditional Results Guarantee described in Section 3 is the sole and exclusive path to a refund of payments made under a coaching enrollment.
1. Medical Disclaimer and Acknowledgment
Club Kaya is a coaching and performance optimization company. We do not provide medical advice, diagnosis, or treatment, and Mitchell and the Club Kaya team are not licensed medical professionals, registered dietitians, or physical therapists. All program content, including training, nutrition, supplement, sleep, and recovery guidance, is educational and performance-based in nature and is not a substitute for professional medical care.
The Client acknowledges that they have consulted, or have had the opportunity to consult, a qualified physician before beginning the program, and that they are physically capable of participating. The Client agrees to disclose any relevant medical conditions, injuries, allergies, or medications at intake and to notify Club Kaya promptly of any changes during the program. The Client assumes all risks associated with physical training, nutrition changes, and lifestyle modification.
2. All Sales Are Final
Due to the personalized nature of the program and the extensive time, attention, and expertise involved, all sales are final. By signing the client agreement and beginning the program, the Client commits to the full 90-day program length and the full investment outlined in their agreement. Club Kaya does not issue refunds, partial refunds, or pro-rata refunds for unused portions of the program outside the Conditional Results Guarantee in Section 3 below.
Coaching is delivered as a continuous service. Personalized programming, 1-on-1 coaching access, training and nutrition protocols, supplement and recovery stacks, and resource hub access are delivered from day one and cannot be returned.
3. Conditional Results Guarantee
Club Kaya stands behind the program. If the Client completes the full 90-day program and does not achieve Significant Results as defined below, the Client is eligible for a full refund of all payments made plus 30 days of additional coaching at no cost, subject to the conditions below.
Defining "Significant Results"
"Significant Results" means measurable progress toward the Client's stated goals, which may include (but are not limited to):
- 3 to 8 lbs of weight loss (depending on starting point)
- Visible muscle gain or strength progression
- Reduction in waist or body measurements
- Improved performance metrics (form, mobility, endurance)
Targets are personalized and documented during onboarding based on the Client's lifestyle, schedule, and physical condition.
Compliance Requirements
To qualify for the Conditional Results Guarantee, the Client must provide verifiable proof of good-faith adherence to the program:
- Training compliance: Complete at least 85% of assigned workouts.
- Nutrition compliance: Follow the nutrition plan at 80%+ accuracy, verified through logs, photos, or screenshots.
- Check-in compliance: Submit all weekly check-ins on time.
- Communication compliance: Report challenges, injuries, or issues within 48 hours of them occurring.
Required Documentation
- Weekly progress photos
- Weight and measurement logs
- Workout logs / app data
- Food logs / screenshots
- Any additional data reasonably required to verify adherence
Failure to provide documentation voids eligibility.
Good-Faith Obligation
The Client agrees to act in good faith throughout the program, including:
- Following the personalized plan as instructed
- Not intentionally undermining progress (e.g., skipping workouts, ignoring nutrition targets, excessive alcohol use)
- Being truthful in check-ins and logs
- Asking for support when needed
Any behavior showing bad faith, dishonesty, or intentional non-compliance voids eligibility. Failure to materially comply with the above requirements, as determined by Club Kaya in its reasonable discretion, voids eligibility for the Conditional Results Guarantee.
Process and Timing
To claim the Conditional Results Guarantee, the Client must submit a written request to Club Kaya within 7 days of completing the program. The request must include all required documentation listed above. Club Kaya will review the claim within 10 business days. If approved:
- The full refund will be issued within 14 days of approval
- The Client will receive an additional 30 days of coaching at no cost, beginning on the date of approval, with the same access provided during the original program
Medical Pause
If the Client experiences a documented injury, illness, or medical event during the program that prevents continued participation, Club Kaya may, in its sole discretion, pause the program timeline and extend the Client's access for an equivalent period. Approved pauses do not shorten the program length for purposes of the Conditional Results Guarantee, do not waive compliance requirements during active program weeks, and do not independently entitle the Client to a refund. Pause requests must be submitted in writing with supporting documentation.
Program Completion
For purposes of this policy, "completion of the program" means the end of the final week of coaching as defined in the Client's signed agreement, inclusive of any approved pauses or extensions.
Limitations
The Conditional Results Guarantee applies only to Clients who complete the full 90-day program, meet all compliance requirements, and submit a timely claim. The guarantee does not apply to Clients who voluntarily cancel before program completion, are removed for non-payment or violations of community standards, or fail to maintain documented engagement throughout the program.
4. Payment Plans and Default
If the Client is on a payment plan and a scheduled payment is missed, Club Kaya may revoke access to coaching, the resource hub, and program materials. The remaining balance under the signed agreement remains due in full. Missed payments do not entitle the Client to a refund of payments already made.
5. Chargebacks
The Client agrees to use the refund process described in this policy as the sole method for resolving any payment dispute. Initiating a chargeback, payment dispute, or reversal with a credit card company, bank, or payment processor without first completing the Conditional Results Guarantee claim process constitutes a material breach of this agreement. In the event of an unauthorized chargeback, Club Kaya reserves the right to (a) revoke all program access immediately, (b) pursue collection of the disputed amount, and (c) recover related costs, including processor fees, collection costs, and reasonable attorneys' fees.
6. Governing Law and Dispute Resolution
This Refund Policy and the Client's enrollment are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to this policy, the client agreement, or the program shall be resolved by binding arbitration administered by JAMS in New Jersey, in accordance with its Streamlined Arbitration Rules and Procedures. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
The Client and Club Kaya each waive the right to a trial by jury and the right to participate in any class, collective, or representative action. All disputes must be brought in the party's individual capacity.
7. How to Request a Conditional Results Guarantee Refund
Email thrive@mitchellsaron.com with the subject line "Conditional Results Guarantee Claim" within 7 days of program completion. Please include:
- Your full name and the date you completed the program
- Your weekly progress photos
- Weight and measurement logs from the duration of the program
- Workout logs / app data
- Food logs / screenshots
- Documentation of weekly check-in submissions and any communications with the coaching team
Club Kaya will review and respond within 10 business days. If approved, the refund will be issued within 14 days and the 30 additional coaching days will begin on the date of approval.
8. Changes to This Policy
We reserve the right to modify this Refund Policy at any time. When we make material changes, we will update the "Last updated" date at the top of this page. The version of the policy in effect at the time the Client signs their agreement governs that enrollment. Continued use of our website or services following the posting of any changes constitutes acceptance of the updated policy for future enrollments.
9. Entire Agreement and Severability
This Refund Policy, together with the signed client agreement and Club Kaya's Terms of Service, constitutes the entire agreement between the Client and Club Kaya regarding refunds and the Conditional Results Guarantee, and supersedes any prior statements, representations, or understandings, whether written or oral. If any provision of this policy is held unenforceable, the remaining provisions will remain in full force and effect.
